The Short Version
This summary is here to help. The full Terms below are what applies, and they win if the two differ.
- These products are general education and general advice in Dr Dan's words. They are not medical advice, not a prescription and not a diagnosis. They do not replace your doctor. See them before you start, stop or change anything, including a supplement or a medication. In an emergency call 000.
- Below the Pro program there is no human support. The AI, the members' group and its monthly event, and the course content are the product. No practitioner reviews your messages.
- You must be 18 or over.
- Monthly products bill monthly in advance through Stripe. Cancel any time through Manage Billing. Your access runs to the end of the month you have paid for. We do not refund part of a month.
- Dr Dan AI comes with one 30-day free trial per person. Your card goes on file, nothing is charged until the trial ends, and if you cancel before then you pay nothing.
- Courses are paid once, with lifetime access, under a personal licence to view: yours for as long as CYORA Courses runs, and if it ever closes you get at least 12 months notice and a way to keep your downloads.
- Every CYORA program includes some or all of these products for a period, so the checkout refuses to charge you for something you already hold, and a program purchase ends a separate subscription for the same thing so you never pay twice.
- The Bloodwork Decoder membership reads the blood test you upload with software, scores it against the CYORA optimal ranges and writes a brief. It is analysis and education, never a diagnosis, and it never replaces the practitioner who can examine you.
- The AI Stool Decoder and the AI DNA Decoder read the report you upload with software and write a brief. They are analysis and education, never a diagnosis, and a DNA report is never given a numeric score.
- The Nutrition and Meal Plan Builder, the Training Plan Builder and the Supplement Protocol Builder build a self-directed plan or blueprint from your own lab reports and a short questionnaire. They are general education, not a practitioner's advice, and the Supplement Protocol Builder gives no doses.
- Your data is stored in Australia and is never sold. Dr Dan AI, the Bloodwork Decoder, the AI Stool Decoder, the AI DNA Decoder and the three builders send what you give them (your question or your report values, your age, your sex, your profile or answers, and any ring data), with your name and contact details removed first, to an AI model run by Anthropic in the United States. That provider may not be bound by Australian privacy law. The Members Club runs on WhatsApp. We delete your data on request except where the law makes us keep it. Your Australian Consumer Law rights are not excluded.
Part A - The Terms That Apply To Every Member Product
1. About These Terms
1.1 These Member Terms ("Terms") are a legal agreement between you and CYORA Pty Ltd (ABN 59 649 153 935) ("CYORA", "we", "us"). They apply to the ten member products in Part B (each a "Member Product"): Dr Dan AI, the CYORA Members Club, CYORA Courses, the CYORA App Continuation, the Bloodwork Decoder membership, the AI Stool Decoder, the AI DNA Decoder, the Nutrition and Meal Plan Builder, the Training Plan Builder and the Supplement Protocol Builder.
1.2 You accept these Terms when you do any of these: tick the box at checkout, pay for a Member Product, start a free trial, or sign in to a Member Product. Signing in is never consent under clause 10.6. Acceptance by those electronic steps is valid under the Electronic Transactions (Queensland) Act 2001 and the Electronic Transactions Act 1999 (Cth).
1.3 Part A applies to every Member Product. Part B holds one Schedule per product. If Part A and a Schedule differ about that product, the Schedule applies.
1.4 The CYORA Terms of Service at cyora.com.au/terms govern our website and the CYORA App generally. For a Member Product, these Terms apply first and the Terms of Service fill any gap.
1.5 If you have signed a CYORA Client Services Agreement and Program Schedule (a "Program"), that agreement governs your Program. These Terms govern the Member Products only. Schedule 4 explains how the two fit together for the App Continuation.
1.6 Our Privacy Policy at cyora.com.au/privacy-policy forms part of these Terms.
1.7 If you do not agree to these Terms, do not buy, start or use a Member Product.
1.8 These Terms are version 1.4, effective from 02/10/2026, and apply to every purchase and trial started on or after that date.
1.9 How you agree, and what we keep. At checkout you tick one box, "I have read and agree to the CYORA Member Terms", beside a link to this page, and a second box that you are 18 or over. There is no separate document to sign. Where a Schedule describes a consent to automated processing or an overseas disclosure, you give it by a separate box at checkout that sets out what you are consenting to in its own words. That box is never pre-ticked. Agreeing to these Terms is not that consent, and you can buy nothing that needs it without ticking it. We record, with your purchase, the version of these Terms and a fingerprint of their exact text, the exact words of each consent box you ticked, the time, the state of each box, and the internet address and browser you used. Signing in is never consent under clause 10.6.
2. Who We Are
2.1 CYORA Pty Ltd, ABN 59 649 153 935, ACN 649 153 935, of 52/17 Great Southern Drive, Robina QLD 4226, Australia. Contact: support@cyora.com.au.
2.2 "Dr Dan" is Dr Daniel Kirkbride, registered with the Australian Health Practitioner Regulation Agency: Osteopath · AHPRA OST0002224719. He uses the title "Dr" as a registered osteopath. He is not a medical practitioner.
2.3 "Dr Dan AI" is a software product built on Dr Dan's teaching, calls, notes and knowledge base. It is not Dr Dan, it is not a practitioner, and using it does not make you Dr Dan's patient or client.
2.4 CYORA sells its coaching programs and the Member Products. CYORA does not sell supplements, and it does not sell any product a Member Product names. Where a Member Product names a supplement, a brand or a product, that is Dr Dan's general recommendation of a product made and sold by somebody else, never one written for you. CYORA has no commercial interest in it, carries no referral or affiliate link to it, and earns nothing when you buy it. The Supplement Protocol Builder names classes of nutrient, never a product or a brand.
2.5 Using a Member Product does not make you a patient or client of Dr Dan or CYORA. The software can be wrong. Nothing in these Terms excludes, restricts or modifies a guarantee or right the Australian Consumer Law gives you, and every exclusion, limit or no-refund term in these Terms, including clause 15.2, applies only to the extent the law allows.
3. Who Can Join
3.1 You must be 18 or over. We may ask for proof of age and may close an account we reasonably believe belongs to a person under 18.
3.2 You must give us accurate details when we ask for them (your name and email, and your mobile at checkout) and keep them current. Your email address is your account.
3.3 One person, one account. You may not share, sell or transfer your account or your access.
3.4 The Member Products are designed for people in Australia. If you use them from elsewhere, you are responsible for any local law that applies to you, and Australian law still governs these Terms.
3.5 The App Continuation has one extra condition: it is only for a client whose Pro, Elite or VIP Program has ended (Schedule 4).
4. What Every Member Product Is, And Is Not
4.1 Every Member Product is general education and general advice in Dr Dan's words. Nothing in any of them is medical advice, a prescription, a diagnosis, a treatment plan or a clinical service.
4.2 No Member Product creates a practitioner-patient or practitioner-client relationship between you and Dr Dan, CYORA or any CYORA practitioner.
4.3 Below the Pro program there is no human support. Plainly: the AI answers your questions, the members' group is conversation between members plus one live event a month, a recording is a recording, and a course is content. No practitioner reads or reviews your messages, your profile, your wearable data or your progress as part of any Member Product. A Member Product is not a way to reach Dr Dan or a CYORA practitioner.
4.4 A Member Product is not a substitute for a consultation with a registered health practitioner who can examine you, take a history and take responsibility for your care.
4.5 Never start, stop or change a medication or a prescribed treatment because of something a Member Product said. A Member Product will not tell you to, and if it ever appears to, treat that as an error.
4.6 In an emergency, or if you are worried about an urgent symptom, call 000 or go to the nearest emergency department. No Member Product is monitored for emergencies and none can respond to one.
4.7 Artificial intelligence can be wrong, incomplete or out of date. Dr Dan AI answers from CYORA's knowledge base and from what you tell it. You are responsible for how you use what it says.
4.8 The Member Products are not for anyone experiencing a mental health crisis, an eating disorder, pregnancy, or an acute or serious illness. If that is you, please use the services built for that.
4.9 You are responsible for your own health decisions and for the accuracy of anything you enter about yourself.
4.10 Results vary. We make no promise that any Member Product will improve any measure of your health, and nothing in them should be read as one.
5. Your Account
5.1 You sign in with your email address and a one-time code sent to it. Keep your email account secure. Anything done through your account is treated as done by you until you tell us otherwise.
5.2 Tell us at support@cyora.com.au straight away if you think someone else has used your account.
5.3 We may suspend an account to protect its security, the service or other members, and we tell you when we do.
5.4 You may close your account at any time by cancelling your subscriptions (clause 7) and asking us at support@cyora.com.au. Section 10 says what happens to your data.
5.5 We may require you to accept an updated version of these Terms to keep using a Member Product (clause 16).
5.6 Your account for one Member Product does not give you access to another. Each is its own product, unless a Program you hold includes it (clause 9).
6. Prices, GST And Payment
6.1 Every price is in Australian dollars. Wherever we show a price, we show the amount before GST with "+ GST" after it and, at least as prominently, the total you pay including GST. The total including GST is the price you are charged, and the checkout shows it before you pay. GST is currently 10%.
6.2 The prices at the date of these Terms are:

6.3 Payments are processed by Stripe. We do not see or store your full card number. Stripe's own terms apply to its service.
6.4 By buying a monthly Member Product you authorise us, through Stripe, to charge the card on file each month until you cancel.
6.5 A tax invoice or receipt for each payment is available through Manage Billing (clause 7.4).
6.6 If a price on a sales page, an email and the checkout ever disagree, the checkout total shown before you pay is the price you are charged. If a CYORA page or email showed you a lower price for the same purchase on the day you bought, tell us and we refund the difference.
7. Monthly Memberships
7.1 Dr Dan AI, the CYORA Members Club, the CYORA App Continuation, the Bloodwork Decoder membership, the AI Stool Decoder, the AI DNA Decoder, the Nutrition and Meal Plan Builder, the Training Plan Builder and the Supplement Protocol Builder are monthly memberships (each a "Monthly Membership").
7.2 A Monthly Membership is billed monthly in advance. The first charge is taken when you buy (or, for Dr Dan AI, when the free trial ends). Each later charge is taken on the same day of each following month, or the last day of a shorter month.
7.3 A Monthly Membership continues month to month until you cancel it or it ends under these Terms. There is no minimum term and no cancellation fee.
7.4 You can cancel at any time through the Manage Billing link in your account (it opens Stripe's secure billing portal), or by emailing support@cyora.com.au from your account email. A cancellation sent by email takes effect from the day we receive it. Cancelling is as easy as signing up.
7.5 When you cancel, your access continues to the end of the period you have paid for (the "Paid Period"), and no further charge is taken.
7.6 We do not refund part of a month. Your Australian Consumer Law rights (section 13) are not affected by this clause.
7.7 If a monthly payment fails, Stripe retries the card over the following days. Your access continues during those retries. If the payment still fails, your membership is cancelled and your access ends. You can restart it any time by subscribing again, without a new trial.
7.8 We may change the price of a Monthly Membership by giving you at least 30 days notice by email. The new price applies from the first renewal after the notice period ends. If you do not want the new price, cancel before that renewal and you will not be charged it.
7.9 We send a reminder to your email before a renewal where the law requires it, and always before a free trial converts to a paid month (clause 8.5).
7.10 We may end a Monthly Membership on 30 days notice by email if we stop offering the product (clause 16.4). If we do, we refund any part of a Paid Period that falls after the end date.
7.11 We may end a Monthly Membership without a refund of the current month if you seriously breach these Terms (clause 15).
7.12 Cancelling a Monthly Membership does not cancel a Program, and cancelling a Program does not by itself cancel a separate Monthly Membership. Each is cancelled where it was bought.
8. Free Trials
8.1 Dr Dan AI comes with a free trial of 30 days. The other Member Products have no trial.
8.2 One free trial per person. We count it by email address, and we may refuse a trial where we reasonably believe you have had one before under another email or that the email belongs to someone else.
8.3 To start a trial you put a card on file with Stripe. Nothing is charged until the trial ends.
8.4 If you cancel before the trial ends, nothing is charged and your access continues to the end of the trial.
8.5 If you do not cancel, the first monthly charge is taken on the day the trial ends and your membership continues month to month under clause 7. We send a reminder to your email before that first charge.
8.6 A person who has held Dr Dan AI before, whether on a trial, a paid month or as part of a Program, is not offered a trial again.
8.7 We may withdraw the free trial offer for new sign-ups at any time. A trial already started runs to its end.
8.8 The trial is offered only on the terms in this section and Schedule 1.
9. Programs Include Member Products
9.1 Where your Program Schedule lists a Member Product, that Schedule governs. Where a Program that is open to new clients today includes Dr Dan AI, the Bloodwork Decoder and the five tools, this clause records it as an added benefit for the period of the Program. It does not change a fee or any inclusion your signed Program Schedule gives you.
9.2 The checkout refuses to sell you a Member Product you already hold, whether through a Program or a separate purchase, so you do not pay twice.
9.3 If you buy a Program while you have a separate Monthly Membership for a product that Program includes, we cancel the separate membership so that it ends at the close of its current Paid Period, and the Program's inclusion takes over from then. No further monthly charge is taken.
9.4 When a Program's included period ends, your access to the included Member Product ends with it. We do not start a paid Monthly Membership for you. If you want to continue, you subscribe yourself at the then-current price, and no trial applies.
9.5 A Program's inclusions are governed by the Program's own agreement. These Terms govern how you use the Member Product while it is included.
9.6 An App Continuation is available only after a Pro, Elite or VIP Program has ended, and never to a Blueprint or Decode client (Schedule 4).
10. Your Data And Privacy
10.1 We handle your personal information under the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles, and as set out in our Privacy Policy. If these Terms and the Privacy Policy differ, the Privacy Policy applies to how we handle your information.
10.2 What we collect depends on the product. Dr Dan AI: your name, email and mobile, the health profile you fill in, your wearable days if you connect a ring, and your conversations. Members Club: your name, email and mobile, your WhatsApp number and profile as WhatsApp shows them to the group, and your voice and image if you join a recorded event with your microphone or camera on. Courses: your name, email and mobile and your lesson progress. App Continuation: what your Client Services Agreement already covers, plus new wearable days and any lab results you upload. Bloodwork Decoder and the five tools: the reports you upload, the markers and values read from them, and your questionnaire answers, including your medications and injuries where you enter them.
10.3 Some of what you give Dr Dan AI, the App Continuation, the Bloodwork Decoder and the five tools is health information, which the Privacy Act treats as sensitive information. You consent to us collecting it for the purposes in clause 10.4 when you tick the Member Terms box at checkout and when you choose to upload it or enter it.
10.4 We use your information to run the Member Product for you, to answer you, to keep the service safe, to bill you, to send you service messages, and to improve the service. Improvement work uses de-identified information wherever possible.
10.5 Your information is stored in Australia, except as clauses 10.6 and 10.7 describe. Each Member Product runs on a database hosted by Supabase in Sydney, and our backups are kept as the Privacy Policy describes.
10.6 To answer you, Dr Dan AI sends the content of your question, your profile and your recent wearable days to an artificial intelligence language model run by Anthropic in the United States, named in the Privacy Policy at https://privacy-policy.cyora.com.au/. Before that happens we remove your name, your email address and your date of birth. What remains may still be personal information about you, so we treat the transfer as a cross-border disclosure under Australian Privacy Principle 8, and we tell you plainly: the provider is outside Australia, it may not be bound by the Australian Privacy Principles, and if it mishandles your information we may not be accountable under the Privacy Act and you may not have a remedy under that Act. You give your express consent to that disclosure by ticking the AI consent at sign-up. S1.8 quotes the tick word for word; starting the chat is not the consent, the tick is. It is the only way the product can work. If you do not want this, do not use Dr Dan AI. You can withdraw your consent at any time by cancelling the Member Product that uses it, through Manage Billing, and asking us to delete your data under clause 10.12; a withdrawal does not undo a disclosure already made. The same applies to every Member Product whose Schedule describes an AI language model: the document reader that reads your upload runs on CYORA's own systems in Australia and is software, not a model, and only your values, your age, your sex and your answers leave Australia, after your name and contact details are removed. That may still be personal information about you. Genetic results cannot be made anonymous by removing a name.
10.7 The Members Club uses WhatsApp, a Meta service hosted overseas. Your use of WhatsApp is governed by WhatsApp's own terms and privacy policy. We do not control what WhatsApp does with your data. Where a members' event is held online it runs on a video platform, and any recording is hosted on our video provider, each named in the Privacy Policy.
10.8 We never sell your personal information. We do not use your health information to target advertising.
10.9 An automated safety filter reads every Dr Dan AI message for signs of an emergency or serious risk. Where it fires, the chat gives you the emergency message and CYORA is notified, and a CYORA person may read that message. This is a safety step, not monitoring, and it is not a promise that anyone will contact you or act. In an emergency call 000.
10.10 CYORA staff, including Dr Dan, may read Dr Dan AI conversations and watch recordings of members' events to check the quality and safety of the product and to improve it. That review is about the product, not about you. It is not a clinical review, no practitioner will act on your health because of it, and it does not make anything a clinical record.
10.11 Your Dr Dan AI profile, wearable days and conversations, your Members Club participation and your course progress are not a clinical or health record. No diagnosis or treatment is recorded, no practitioner is responsible for them, and they are not part of any CYORA client file. The App Continuation is the exception: Schedule 4 explains that your clinical records stay a health record under your Client Services Agreement.
10.12 You may ask us at support@cyora.com.au to access or correct your information, and to delete it. We delete on request within 30 days, except what the law requires us to keep: tax and payment records, records of a safety incident or a complaint, and, for the App Continuation, your clinical records for the period set by your Client Services Agreement. Hiding a Dr Dan AI conversation in the app hides it from you; it does not delete it. Ask us to delete.
10.13 If you disconnect a wearable, the days already on file stay unless you ask us to delete them.
10.14 You must not enter another person's health information into a Member Product, and you must not enter information about a child.
10.15 We protect your information with encryption in transit and at rest, access controls and logging. If a data breach is likely to cause you serious harm we will tell you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.
10.16 We may send you emails about CYORA products. You can unsubscribe from marketing at any time. Service messages about your membership, billing and safety continue while you are a member.
11. Intellectual Property And Your Licence
11.1 CYORA owns, or holds the licence for, everything in the Member Products: the Dr Dan AI system and its knowledge base, every answer it produces, the course videos, lessons and resources, the recordings of members' events, the CYORA name and logos, the name Dr Dan, and the frameworks, methods and language used in them.
11.2 We give you a personal, non-exclusive, non-transferable licence to use the Member Products you hold for your own personal, non-commercial use, for as long as you hold them and comply with these Terms.
11.3 You may not: copy, record, download, screenshot, share, publish, resell, sublicense or distribute any part of a Member Product; use it to build, train or improve a product or service; teach, coach or advise others from it commercially; or remove any notice of ownership. The one exception is a resource a course itself offers you to download, which you may keep for your own use.
11.4 You own what you write into a Member Product. You give us a licence to store, process, de-identify and use it to run and improve the Member Products, for as long as we hold it under section 10.
11.5 If you join a recorded members' event with your microphone or camera on, you consent to us recording it and making the recording available to members. We will not use your image, voice or words from an event or the group in our marketing without your separate written consent, and never as a testimonial about a health service, which the law does not allow.
11.6 If you give us feedback or a suggestion, we may use it without owing you anything.
11.7 You may share what you have learned in your own words, with attribution, in a way that does not reproduce our content.
11.8 Nothing in these Terms transfers any CYORA intellectual property to you.
11.9 The licence in clause 11.2 survives the end of a Monthly Membership only for content you are entitled to under a Schedule (for example, a course you bought outright), and ends with the product for everything else.
12. Acceptable Use
12.1 You must not use a Member Product to: break any law; harm, harass, threaten or deceive anyone; deliberately work around the product's safety rules to obtain a diagnosis, a prescription, a dose or a medication decision; access or attempt to access another member's data; scrape, probe, reverse engineer or interfere with the product or its security; use bots or automated access; share or sell your access; or promote, sell or solicit for any business or cause.
12.2 In the Members Club you must also follow the conduct rules in Schedule 2.
12.3 If you breach this section we may suspend or end your access under section 15.
13. Australian Consumer Law
13.1 Our Member Products come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (the "ACL"). Among them: services must be provided with due care and skill, be fit for any purpose you told us about, and be supplied within a reasonable time. Whether the law treats a course as goods or a service, the guarantees apply.
13.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified.
13.3 If a Member Product has a major failure you may cancel it and receive a refund for the unused part, or keep it and receive a reduced price, and you may claim compensation for other reasonably foreseeable loss. If the failure is not major we may fix it within a reasonable time; if we do not, you may cancel and receive a refund for the unused part.
13.4 The consumer guarantees are about how we deliver the Member Products. They are not a guarantee of any health outcome, and no Member Product makes one.
13.5 Change of mind. A Monthly Membership can be cancelled at any time and ends at the close of the Paid Period; we do not refund a month already started because you changed your mind. For Courses, see the change of mind policy in Schedule 3. Where we have published a change of mind policy we follow it.
13.6 To make a claim, email support@cyora.com.au with your account email and what went wrong. We respond within 5 business days and aim to resolve within 30 days.
13.7 The Unfair Contract Terms rules of the ACL apply to these Terms. We have written them to be balanced: you can cancel at any time, we give notice before a price or terms change and you can leave before it applies, and our rights to end a membership are matched by a refund of any unused Paid Period unless you are in serious breach.
14. Our Liability To You
14.1 Nothing in this section limits or excludes any liability that cannot be limited or excluded by law, including liability for a failure to comply with a consumer guarantee where the ACL does not allow us to limit it, liability for death or personal injury caused by our negligence, or liability for fraud.
14.2 Subject to clause 14.1, and to the extent the law allows, our total liability to you for all claims arising out of or in connection with a Monthly Membership in any month is limited to the amount you paid us for that membership in the month before the event giving rise to the claim; and for a Course or the bundle, to the amount you paid us for it. This clause does not limit our liability for a breach of the Privacy Act 1988 (Cth) or for a misleading statement by us.
14.3 Subject to clause 14.1, neither of us is liable to the other for indirect or consequential loss, loss of profit, loss of data that was not in our care, or loss caused by something outside our reasonable control.
14.4 Subject to clause 14.1, we are not liable for loss that arises because you did not follow clause 4 (in particular, because you acted on a Member Product instead of consulting a registered health practitioner, or changed a medication or treatment because of it), because you gave us inaccurate information, or because of a third-party service such as WhatsApp, Oura or Stripe.
14.5 We do not promise that a Member Product will be available without interruption. We maintain and improve it, and sometimes it is down. If Dr Dan AI is unavailable for more than 7 days in a row in a Paid Period, ask us and we credit that Paid Period.
14.6 The limits in this section apply to CYORA, its directors, officers, employees, contractors and practitioners.
15. Suspension And Termination
15.1 By you. Cancel any Monthly Membership under clause 7.4 and close your account under clause 5.4.
15.2 By us for serious breach. We may suspend or end your access to a Member Product immediately if you seriously breach these Terms, including by sharing access, abusing another member, deliberately working around the safety rules to obtain a prescription or a dose, interfering with the product, or using it unlawfully. We tell you why. A serious breach ends the current Paid Period without refund and, for Courses, ends your licence without refund, except where the ACL requires a refund.
15.3 By us for other breach. For any other breach we tell you what is wrong and give you 7 days to fix it. If it is not fixed, we may end your access at the close of the Paid Period.
15.4 By us without cause. We may end a Monthly Membership on 30 days notice under clause 7.10 with a refund of any unused Paid Period. We may end the Courses product only as Schedule 3 sets out.
15.5 On ending, your access stops (or stops at the close of the Paid Period, where these Terms say so), and section 10 governs your data.
15.6 Sections 4, 10, 11, 13, 14, 17 and 18, and any clause that by its nature should survive, continue after these Terms end.
15.7 Ending a Member Product does not end a Program, and ending a Program does not end a separately bought Member Product, except as clause 9 provides.
15.8 We may remove a member from the Members Club group under Schedule 2 without ending the rest of their membership, and we tell them what happens to their billing when we do.
15.9 If we end your access in error, tell us and we restore it and refund any charge for the time you were locked out.
16. Changes To These Terms And The Products
16.1 We may change these Terms. For a change that reduces your rights or increases your obligations, we give at least 30 days notice by email and in the product before it applies. For other changes, such as a correction, a new product or a change the law requires, we may give shorter notice.
16.2 If you do not accept a change, cancel before it applies and it will not apply to you. Continuing to use a Member Product after a change applies means you accept it.
16.3 We may improve, change, add to or replace features of a Member Product. We will not remove a core inclusion listed in a Schedule during a Paid Period without the notice in clause 16.1 and your right to cancel.
16.4 We may stop offering a Member Product. For a Monthly Membership we give at least 30 days notice and refund any unused Paid Period. For Courses, Schedule 3 applies.
16.5 The current Terms are always at cyora.com.au/terms/members. Each version carries its effective date.
16.6 A change to a price is governed by clause 7.8, not by this section.
17. Complaints And Regulators
17.1 If something is wrong, tell us first at support@cyora.com.au. We acknowledge within 5 business days and aim to resolve within 30 days.
17.2 Nothing in these Terms prevents you from making a complaint to, providing information to, or cooperating with any regulator, ombudsman, court or law enforcement body, including the Australian Health Practitioner Regulation Agency, the Office of the Health Ombudsman (Queensland), the Office of the Australian Information Commissioner, the Australian Competition and Consumer Commission and the Queensland Office of Fair Trading, or from making any disclosure required or authorised by law.
17.3 Privacy complaints may also go to the Office of the Australian Information Commissioner at oaic.gov.au or 1300 363 992.
17.4 Consumer complaints may also go to the Queensland Office of Fair Trading or the ACCC.
17.5 We do not treat a complaint to a regulator as a breach of these Terms.
18. General
18.1 Governing law. These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them. The ACL applies to you regardless of this clause.
18.2 Severance. If any part of these Terms is void or unenforceable, that part is severed and the rest continues.
18.3 No waiver. If we do not enforce a term, we can still enforce it later.
18.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours to a related company or a buyer of the business, and we tell you if we do.
18.5 Notices. We send notices to your account email. You send notices to support@cyora.com.au. An email is received on the business day it is sent, or the next business day if sent after 5:00 PM AEST.
18.6 Third parties. Stripe, WhatsApp, Oura and our video and email providers are independent businesses. Their terms govern their services, and we are not responsible for them.
18.7 Entire agreement. These Terms, the Schedule for the product you hold, and the Privacy Policy are the whole agreement between you and us for a Member Product. Nothing in this clause limits your rights under the ACL or excludes liability for a misleading statement.
18.8 Records. We keep an electronic record of your acceptance, purchases, cancellations and consents, and it is evidence of them.
18.9 Reading these Terms. Headings are for reading. "Including" means "including without limitation". A reference to a law includes any change to it.
19. Definitions
- "ACL" means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- "Course" means a course in the CYORA Courses library sold on its own; "the bundle" means the bundle of courses in Schedule 3.
- "Manage Billing" means the link in your account that opens Stripe's billing portal.
- "Member Product" means each of the ten products in Part B.
- "Monthly Membership" means each product described in clause 7.1.
- "Paid Period" means the month you have paid for, or the free trial while it runs.
- "Program" means a CYORA coaching program (Blueprint, Decode, Pro, Elite or VIP) bought under a Client Services Agreement and Program Schedule.
- "Program Schedule" means the schedule to your Client Services Agreement that sets out your Program's inclusions.
- "You" means the person who accepted these Terms.
Part B - The Product Schedules
Schedule 1 - Dr Dan AI
S1.1 What it is. Dr Dan AI is an artificial intelligence chat at dr-dan-ai.cyora.com.au, built on Dr Dan's knowledge base, that answers your questions in his words, day or night. It comes with a health profile you fill in and an optional connection to your Oura ring.
S1.2 What is included: the Dr Dan AI chat; a health profile you fill in and can update; the option to connect an Oura ring so the last fortnight of your sleep, recovery and activity data informs the answers.
S1.3 What is not included: a consultation, a coaching call, a protocol, a plan, a supplement list written for you, lab analysis, the CYORA App, the Members Club, a course, and any human on the other end of a message.
S1.4 Price and trial. US$97 a month in US dollars, which is the total you pay; GST is included where it applies. One 30-day free trial per person under section 8: card on file, nothing charged until the trial ends, cancel before then and nothing is charged.
S1.5 General advice and education only. Dr Dan AI gives general advice and education. It is not medical advice, not a prescription, not a diagnosis, and it never changes a protocol. It does not replace your doctor. See them before you start, stop or change anything, including a supplement or a medication. It does not comment on medications. It may offer one considered suggestion about training, eating or supplements, in general terms, drawn from what you have told it: never a dose written for you, never a change to a medication, and never a price. Today it names no supplement brand, shop or product at all, and says so if you ask. If we later connect the list of products Dr Dan recommends to the chat, it will name a product from that list only when you ask which one, in its answer to you alone and never in anything we publish: the product's name, and that it is the one Dr Dan recommends, with no link, no shop, no code, no price, no claim about what that product will do for you, and still never a dose written for you. Every product on that list is made and sold by somebody else; CYORA does not sell it and earns nothing when you buy it (clause 2.4). What the chat teaches you about an ingredient is general education. A suggestion, and a product name, is general information for you to weigh, not a recommendation made for you by a practitioner who has examined you. In an emergency call 000.
S1.6 The chat shows this notice: "General education only - not a diagnosis, a prescription or medical advice. It does not replace your doctor. In an emergency call 000." That notice applies to every answer whether or not an answer repeats it.
S1.7 Not a substitute. Dr Dan AI is not a substitute for a consultation with a registered health practitioner who can examine you. Where the right answer is that your question needs a person working on your case, the chat says so and tells you that CYORA's coaching programs are one place that happens. That is information, not a referral, and buying a Program is entirely your choice.
S1.8 Adults only, and your consent. You confirm at sign-up that you are 18 or over. You also tick the AI consent. It is shown at checkout or, if Dr Dan AI is included in your Program, the first time you use it, and it reads: "I understand that the answering of my questions is done by software, and that my question, my profile and any ring data (with my name and contact details removed first) are sent to an AI language model run by Anthropic in the United States. That provider may not be bound by Australian privacy law. If I agree, CYORA will not be responsible under the Privacy Act for how that provider handles my information, and I may have no remedy under that Act. I agree to that disclosure." That tick is your express consent to the overseas disclosure in clause 10.6, given after the tick itself and clause 10.6 have told you that the provider may not be bound by the Australian Privacy Principles, that we may not be accountable under the Privacy Act if it mishandles your information, and that you may not have a remedy under that Act. We record the exact words of the box, the time and the state of the box, as clause 1.9 says.
S1.9 Your profile. The profile asks for your sex, date of birth, height, weight, occupation, goal, medical history, symptoms, medications, supplements, training, sleep and diet, in your own words. Every field is optional. The more you tell it, the better it answers, and everything you enter is health information under section 10.
S1.10 Your ring. Connecting an Oura ring is optional and uses a token or authorisation you give us. We fetch your daily sleep, readiness, heart rate and activity summaries. You can disconnect at any time; the days already on file stay unless you ask us to delete them. Oura's own terms govern your ring.
S1.11 Your conversations are not a clinical record (clause 10.11). No practitioner reads them as part of the product. An automated safety filter and a quality review apply as clauses 10.9 and 10.10 describe.
S1.12 Accuracy. Answers are generated by software from CYORA's knowledge base and what you have told it. They can be wrong, incomplete or out of date, and they are not tailored to a medical condition. They are not a substitute for a consultation with a registered health practitioner who can examine you.
S1.13 Included in every Program. Every CYORA Program includes Dr Dan AI for the period in your Program Schedule. Section 9 explains how a separate subscription ends so you do not pay twice.
S1.14 Fair use. Dr Dan AI is for your own personal use. We may apply reasonable limits on the number and length of messages to keep the service running for everyone, and we tell you if you reach one.
Schedule 2 - The CYORA Members Club
S2.1 What it is. The CYORA Members Club is a private members' group with Dr Dan: a members-only WhatsApp group and one live event with Dr Dan each month, online or in person. It is a members club, not a course, not a consultation and not coaching.
S2.2 What is included: the members' WhatsApp group; one live event with Dr Dan each month, online or in person, at the day, time and place published on the Club page; and, where an online event is recorded, we may share the recording in the group.
S2.3 Minimum. We hold at least one live event with Dr Dan each month. If Dr Dan cannot host, the event moves to another day, or another CYORA practitioner or coach hosts it, and we tell you which. A single event may be moved for illness, travel or a public holiday, and a moved event on its own does not earn a refund. Your Australian Consumer Law rights (section 13) are not affected.
S2.4 What is not included: courses, consultations, coaching calls, a protocol, Dr Dan AI, the CYORA App, the Elite and VIP coaching rooms, and personal replies from Dr Dan or a practitioner in the group.
S2.5 Price. $97 + GST a month, which is $106.70 a month including GST. No trial. Billed monthly in advance from the day you join.
S2.6 The group is general conversation and education. Nothing said in the group or at an event by Dr Dan, a host or another member is medical advice, a prescription or a diagnosis. Members share experience; they do not treat each other.
S2.7 No human support. The group is not a support line. Dr Dan and CYORA staff may be present in the group but do not promise to read, answer or act on any message. No practitioner reviews the group. For an emergency call 000, not the group.
S2.8 Conduct rules. In the group and at events you must: treat every member with respect; keep what other members share confidential and inside the room; not give or ask for medical advice, doses, medication changes or a diagnosis; not record, screenshot, forward or publish any part of the group or an event; not promote, sell, recruit or solicit for any business, product or cause; not post content that is abusive, discriminatory, sexual, illegal or unsafe; and follow a host's reasonable directions at an event.
S2.9 Removal for breach. We may remove a member from the group or an event, immediately and without a refund of the current month, for a breach of the conduct rules or section 12. For a first minor breach we may warn instead. Removal from the group for a serious breach ends the membership under clause 15.2.
S2.10 Recording. A members' event held online may be recorded and the recording made available to members. By joining a recorded event with your microphone or camera on, you consent to being recorded. You may attend with your camera off and stay muted. Recordings are for members only and stay CYORA's property.
S2.11 In person events. An in-person event is attended at your own cost and your own risk. You must follow the venue's rules and any registration steps we set. Some events may carry a separate fee, which we tell you before you book.
S2.12 WhatsApp. The group runs on WhatsApp under WhatsApp's own terms. Your number and profile are visible to other members as WhatsApp shows them. We may move the group to another platform on 30 days notice.
S2.13 Ending the group. We may close the group or the Members Club on at least 30 days notice by email. If we do, we refund any unused part of a Paid Period. We may also pause the group for a short period, for example over the holidays, and tell you first.
S2.14 Included in every Program. Every CYORA Program includes the Members Club for the period in your Program Schedule. Section 9 applies.
Schedule 3 - CYORA Courses
S3.1 What it is. CYORA Courses is a library of short, self-paced video and written courses by Dr Dan at courses.cyora.com.au. You buy a single course, or the bundle.
S3.2 What is included. A single course: every module, lesson and resource in that course, including updates we make to it. The bundle: every course in the CYORA Courses library that is published for sale on the day you buy, and every new course we add to the library for sale while you hold the bundle, at no extra charge.
S3.3 What is not included: a consultation, coaching, a protocol, Dr Dan AI, the Members Club, lab analysis, the CYORA App, live events, and content that is part of a Program only (for example the Elite and VIP coaching room recordings and the Decode program course). A human on the other end of a message is not included; the course is the product.
S3.4 Price. A single course: $297 + GST, which is $326.70 including GST. The bundle: $997 + GST, which is $1,096.70 including GST. Paid once. No payment plan. A single course you have bought is never credited against the bundle: you either buy the bundle up front, to save, or buy one course at a time at full price.
S3.5 Lifetime access. Your access to a course, or to the bundle, is lifetime access: it runs for as long as CYORA Courses runs, with no renewal fee and no end date. Lifetime access is access to view under the licence in S3.6, never ownership of the content. If we ever stop offering CYORA Courses, we give you at least 12 months notice by email and a way to keep the downloadable resources you hold before it closes. The sales pages, the welcome email and your account page say the same thing.
S3.6 Your licence. You have a personal, non-exclusive, non-transferable licence to view the courses you hold, for your own personal, non-commercial learning, under section 11. You may not share your login, download or record a video, copy or distribute a lesson, or resell or teach from the content. Resources a course offers for download are for your own use only.
S3.7 Education only. A course is general education in Dr Dan's words. It is not a consultation, it does not diagnose, it does not prescribe and it never changes a protocol. Nothing in a course is written for you personally. In an emergency call 000.
S3.8 Changes to a course. We may update, re-record, rename or replace a lesson or a course. Where we retire a course from the library, a course you hold stays open to you, or we give you the course that replaces it.
S3.9 Consumer guarantees. The ACL consumer guarantees apply to every course and the bundle and are not excluded (section 13).
S3.10 Change of mind. If you ask within 7 days of purchase and have not started any lesson, we refund the course or the bundle in full. Once a lesson has been started there is no change of mind refund; the library records when a lesson is started. This policy is in addition to your ACL rights, and a refund for a course that is faulty or not as described is never limited by it.
S3.11 Included in every 12-month Program. Pro, Elite and VIP include every course for the 12 months of the Program. Section 9 applies, and the checkout refuses to charge a person who already holds the course.
S3.12 Progress. We record which lessons you open and complete so the library keeps your place. That record is not a clinical record.
Schedule 4 - The CYORA App Continuation
S4.1 What it is. The App Continuation keeps the CYORA App open for a client whose Pro, Elite or VIP Program has ended, with three things on: Dr Dan AI chat, your wearable integration, and Dr Dan AI lab analysis. Everything else switches off.
S4.2 Who can have it. Only a client whose Pro, Elite or VIP Program has ended. It is not offered to a Blueprint or Decode client. The checkout checks and, if that is not you, refuses and charges nothing.
S4.3 What is included: Dr Dan AI chat in the App, with your CYORA file behind it (with your name and contact details removed before it reaches the AI model); your wearable, still connected, with new days landing in the App; and Dr Dan AI lab analysis of results already in your App record and of results you upload in a format the App accepts. Each analysis of an uploaded result is released by Dr Dan in the App before you see it, the same step every result passes during a Program; that release checks the page is complete and is not a consultation.
S4.4 What is not included: consultations, coaching calls, new protocol builds, changes to a protocol, the coaches' WhatsApp group, the Classroom, the Members Club, lab ordering, and practitioner review of anything. Your plans, calls and Classroom come back only with a new Program.
S4.5 Price. $197 + GST a month, which is $216.70 a month including GST. No trial. Billed monthly in advance from the day you subscribe. Your App login stays the same.
S4.6 Lab analysis is analysis only. It shows what each marker is and what your result shows against CYORA's ranges. It is not a prescription, it is not a diagnosis, it never changes what you take, and no practitioner reviews your case under the continuation: Dr Dan's release of an analysis (S4.3) is a check that the page is complete, not a consultation. It does not replace your doctor. See them before you start, stop or change anything, including a supplement or a medication. It is not a substitute for a consultation with a registered health practitioner who can examine you. In an emergency call 000.
S4.7 Dr Dan AI in the App is the same general advice and education product described in Schedule 1, with your CYORA file as context. It does not change your protocol, and it does not reach a practitioner.
S4.8 No human support. The continuation is software. No practitioner, coach or CYORA staff member reviews your chat, your wearable data, your uploads or your progress under it, other than the automated safety filter and the quality review in clauses 10.9 and 10.10.
S4.9 Your Client Services Agreement continues. Part One of your Client Services Agreement continues to apply to your clinical records, your privacy, the consents you gave at signing and the disclaimers. Your Program Schedule has ended and its inclusions are not revived by the continuation. If these Terms and your Client Services Agreement conflict about the continuation, these Terms apply to the continuation and your Client Services Agreement applies to everything else.
S4.10 Your records stay a health record. Everything in your CYORA client file, including anything added while you hold the continuation (new wearable days, uploaded results and their analysis, and your App chat), remains part of your client health record. We keep it for at least seven years from the last entry, as your Client Services Agreement and the Privacy Policy set out. It is not deleted on request during that period; you may ask for a copy at any time under the Privacy Act.
S4.11 Past protocols. Your past plans stay in the App for you to read, read-only. Nothing new is built and nothing is changed under the continuation. You may also ask for a copy at support@cyora.com.au.
S4.12 Renewing a Program. If you buy a new Pro, Elite or VIP Program while on the continuation, clause 9.3 applies: the continuation ends at the close of its current Paid Period and the Program takes over.
S4.13 Ending. Cancel any time under clause 7.4; access runs to the end of the Paid Period. When it ends, the App closes for you and your record is kept as clause S4.10 says.
Schedule 5 - The Bloodwork Decoder
S5.1 What it is. The Bloodwork Decoder is software at bloodwork-decoder.cyora.com.au. You upload the PDF report your laboratory gave you; an automated system reads the markers, scores each one against the CYORA optimal ranges and produces a report with your biomarker score, an estimated biological age and a written brief in Dr Dan's words on what the pattern shows. The estimated biological age is a calculation from your markers. It is not a clinical measurement and not a diagnosis. The membership lets you upload every blood test you get and keeps your reports side by side.
S5.2 What is included: uploads of your own Australian blood test reports as often as you test; a report for each upload; your reports kept together while you are a member so the trend can be read.
S5.3 What is not included: a consultation, a coaching call, a protocol, a supplement list or a plan written for you, a practitioner reading your file, Dr Dan AI, the Members Club, the CYORA App and a course. A human on the other end of a message is not included; the software is the product.
S5.4 Price. $97 + GST a month, which is $106.70 a month including GST. No trial. Billed monthly in advance from the day you join. The free one-off Decoder report CYORA offers at the same address is a separate thing with its own consent, and buying the membership never charges you for a free report you already received.
S5.5 Analysis and education only. A Decoder report is an analysis of the numbers on your report against the CYORA optimal ranges, with education on what each marker is and what the result shows. It is not medical advice, not a prescription, not a diagnosis, and it never tells you to start, stop or change a medication, a supplement, a diet or training. It does not replace your doctor. See them before you start, stop or change anything, including a supplement or a medication. It is not a substitute for a consultation with a registered health practitioner who can examine you, and it never replaces the practitioner who ordered your test. The CYORA optimal ranges are CYORA's own view of where a marker sits for performance and longevity; they are narrower than a laboratory's reference range, and a result outside a CYORA range is not a disease. A report cannot tell you whether a result is urgent, and a result inside a CYORA range is not a clearance. If you are unwell or a result worries you, speak to the registered practitioner who ordered your test. In an emergency call 000.
S5.6 Automated reading, and your consent to it. The report is produced by software, not by a practitioner. A document reader extracts the values from the PDF, the CYORA scoring service scores them, and an artificial intelligence language model writes the brief from the scored markers. Before anything reaches that model we remove your name and contact details; the model receives marker names, values, your age and your sex only. The model is run by Anthropic in the United States, as our Privacy Policy names it, and clause 10.6 applies to it as it applies to Dr Dan AI: the provider may not be bound by the Australian Privacy Principles, CYORA may not be accountable under the Privacy Act if the provider mishandles your information, and you may not have a remedy under that Act. You give your express consent to that disclosure by the separate AI and overseas-disclosure box, shown at checkout or, if the product is included in your Program, the first time you use it, which is never pre-ticked (clause 1.9), having been told these things here. The document reader runs in Australia and your name and contact details are removed before anything leaves Australia.
S5.7 Accuracy. Software can misread a value, a unit or a date on a scanned report, and the scoring is only as good as the numbers it reads. Every report shows you the values it read so you can check them against your paper. If a value is wrong, the report is wrong at that marker; tell us at support@cyora.com.au and we re-run it. A marker the reader cannot read, or that CYORA has no range for, is shown as unscored, never guessed.
S5.8 Your blood report. Your uploaded report and the markers read from it are health information under section 10. They are stored in Australia. We keep them while you are a member so your reports can be compared, and for 90 days after your membership ends, then delete them unless the law requires us to keep them. You can ask us to delete them sooner. If you become a CYORA client, your Decoder reports may be read into your clinical file with your consent at that time.
S5.9 Not a clinical record. Your Decoder reports are not a clinical or health record kept by a practitioner (clause 10.11). No practitioner reviews them as part of the product.
S5.10 Adults only, and whose information it is. You confirm at checkout that you are 18 or over. You may upload only your own report and your own answers. Do not upload another person's report or information, because they cannot give the consents in clause 10.6, and do not enter information about a child.
S5.11 Included in every Pro, Elite and VIP Program. Those Programs include the Bloodwork Decoder membership for the period in your Program Schedule. Section 9 applies.
S5.12 Fair use. The membership is for your own tests. We may apply reasonable limits on the number of uploads to keep the service running for everyone, and we tell you if you reach one.
Schedule 6 - The AI Stool Decoder
S6.1 What it is. The AI Stool Decoder is software at stool-decoder.cyora.com.au. You upload the PDF stool report your laboratory gave you; an automated system reads the markers, scores each one against the CYORA ranges and produces a report with every marker colour banded and a written brief in Dr Dan's words on what the pattern shows. You also answer a few short questions about your health history so the brief has context. The membership lets you use it as often as you like and keeps your results together.
S6.2 What is included: uploads of your own stool test reports as often as you test; a report for each upload; your reports kept together while you are a member so the trend can be read.
S6.3 What is not included: a consultation, a coaching call, a protocol, a supplement list or a plan written for you, a practitioner reading your file, a stool test (you bring your own report), Dr Dan AI, the Members Club, the CYORA App and a course. A human on the other end of a message is not included; the software is the product.
S6.4 Price. $97 + GST a month, which is $106.70 a month including GST. No trial. Billed monthly in advance from the day you join.
S6.5 Analysis and education only. A report from the AI Stool Decoder is an analysis of the stool test reports you upload, with education on what each item is and what the result shows. It is not medical advice, not a prescription, not a diagnosis, and it never tells you to start, stop or change a medication, a supplement, a diet or training. It does not replace your doctor. See them before you start, stop or change anything, including a supplement or a medication. It is not a substitute for a consultation with a registered health practitioner who can examine you. The CYORA ranges are CYORA's own view of where a marker sits for gut health; a result outside a CYORA range is not a disease. A report cannot tell you whether you need urgent care. If you have blood in your stool, black stools, severe or worsening pain, a fever, or you are dehydrated, seek urgent care or call 000.
S6.6 Automated reading, and your consent to it. The output is produced by software, not by a practitioner. A document reader extracts the values from your upload, CYORA's own tools apply CYORA's ranges and libraries, and an artificial intelligence language model writes the words from those results. Before anything reaches that model we remove your name and contact details; the model receives values, your age, your sex and your questionnaire answers only. The model is run by Anthropic in the United States, as our Privacy Policy names it, and clause 10.6 applies to it as it applies to Dr Dan AI: the provider may not be bound by the Australian Privacy Principles, CYORA may not be accountable under the Privacy Act if the provider mishandles your information, and you may not have a remedy under that Act. You give your express consent to that disclosure by the separate AI and overseas-disclosure box, shown at checkout or, if the product is included in your Program, the first time you use it, which is never pre-ticked (clause 1.9), having been told these things here. The document reader runs in Australia and your name and contact details are removed before anything leaves Australia. Do not type names or contact details into your answers.
S6.7 Accuracy. Software can misread a value, a unit or a date on a scanned report, and the output is only as good as the numbers and answers it is given. The output shows you what it read so you can check it against your paper. If something is wrong, tell us at support@cyora.com.au and we re-run it. Anything the software cannot read, or has no CYORA reference for, is shown as not read, never guessed.
S6.8 Your information. What you upload and what you answer is health information under section 10. It is stored in Australia. We keep it while you are a member so your results can be compared, and for 90 days after your membership ends, then delete it unless the law requires us to keep it.
